It's important to be optimistic and focus on a bright future. However, we must also take a stand against those who commit evil acts, such as the violation of intellectual property rights. Copyright infringement, in particular, is a deplorable act of intellectual theft that displays a blatant disregard for professionalism, morality, ethics, and the law. It undermines the hard work and innovation of others and is a shameful, unprofessional, dishonest, immoral, unethical, and illegal practice. Those who engage in copyright infringement should be identified and held accountable for their actions. Taking a stand against those who commit evil acts helps ensure that justice is served and that others are protected from harm.

IP rights are so important that IP theft is a federal crime.

Scott M. Graffius maintains, enforces, and protects his copyrights and other IP rights. When others infringe on Graffius’ IP rights, situations generally fall into one of two categories:

  1. IP owner Graffius notifies the offending party of their infringement and the required remediation, and the matter is resolved; or
  2. IP owner Graffius notifies the offending party of their infringement and the required remediation, and the offending party’s action or inaction necessitates that qualified attorney and/or a U.S. agency is engaged, and the matter is resolved.

Most situations fall under category 1. However, some offending parties seem determined to make an already bad situation worst; they fall under category 2.

This article covers the news that certification/training company CertiProf violated Scott M. Graffius’ intellectual property rights by misusing his ‘Phases of Team Development’ copyrighted 2018 property.

And CertiProf did not quote or attribute the work to Graffius, thereby falsely leading readers to believe that it was the author and owner of Graffius’ IP. For those reasons, CertiProf violated Graffius’ IP rights. Specifically, CertiProf infringed on Graffius’ copyright; CertiProf’s use was not ‘fair use.’

CertiProf's outrageous infringement has damaged the marketability and value of Graffius' ‘Phases of Team Development’ IP.

Ensuring the integrity of intellectual property is paramount. Graffius is resolute in protecting and enforcing my copyrights and other IP rights.

Graffius will seek, and obtain, the maximum penalties allowed by law. It will include special remedies against CertiProf for “willful infringement.”

Additionally, the U.S. Copyright Office informs that: "In cases of willful infringement for profit, the U.S. Attorney may initiate a criminal investigation."

Furthermore, the National Intellectual Property Rights Coordination Center (IPR Center) recently received details on this case. The IPR Center combats copyright infringement and other intellectual property theft and related crimes through coordinated efforts with domestic and international partners. It operates under the auspices of U.S. Immigration and Customs Enforcement (ICE), which is a component of the Department of Homeland Security (DHS).

These are serious federal cases against CertiProf, involving significant financial and other consequences.

Attributions and Other Notes

Certification/training company CertiProf violated Scott M. Graffius’ intellectual property (IP) rights by misusing his ‘Phases of Team Development’ copyrighted 2018 property. CertiProf did not request nor receive permission to use Graffius’ IP, it used effectively all of Graffius’ respective IP, it used Graffius’ IP word-for-word, it used Graffius’ IP commercially (in its certification/training program, for its financial benefit), and it did not quote or attribute the work to Graffius (thereby falsely leading readers to believe that it was the author and owner of Graffius’ IP). For those reasons, CertiProf clearly violated Graffius’ IP rights. Specifically, CertiProf infringed on Graffius’ copyright; CertiProf’s use was not ‘fair use.’

In accordance with the fair use doctrine, thumbnails of two (out of 89) pages from CertiProf’s 2023 Agile Leader Professional Certification (ALPC) document are used with attribution for purposes of news reporting and critical analysis. Those highly limited excerpts are of the cover page and page 63 (on page 63, CertiProf illegally includes Graffius’ 2018 copyrighted property). Those excerpts provide crucial insight into CertiProf’s violation of Graffius’ IP, allowing readers to better understand the context and implications of the copyright infringement. This approach enhances transparency and facilitates informed public discourse.

Also consider that an unhappy, irritated, or frustrated person may be labeled as “angry.” And a tough, difficult, or demanding person may be labeled as “nasty.”

Introduction


Chances are that you’ve already participated in some form of negotiations in your personal or professional life and that you’ll do so in the future. Negotiation is defined as a discussion between two or more parties aimed at resolving points of difference, crafting outcomes to satisfy various interests, or otherwise establishing an agreement. Handling a job offer, asking for a promotion, and buying and selling property such as a car or a house are just a few examples of deals you may have executed. Enhancing your negotiation strategies, tactics, and skills can have a big payoff on the outcomes of future deals.

What can you add to your arsenal to help you maximize value at your next visit to the bargaining table? How about this: Is it advantageous to be nice or nasty in a negotiation? “The Interpersonal Effects of Anger and Happiness in Negotiations” — a study by Gerben A. Van Kleef and colleagues at the University of Amsterdam — uncovered the answer. Read on to gain insights from the work.

The study encompassed three experiments. The first experiment involved a computer-mediated negotiation in which participants couldn’t see their opponent. And participants were led to believe their counterpart was either happy or angry. The findings follow. Participants with an opponent who they thought was angry placed lower demands and made larger concessions than did participants with an opponent who they thought was happy.

The procedure for experiment 2 was similar to the first one. This one further explored the effect of the informed mood of negotiation counterparts. The results showed that participants used information on mood to infer their opponents’ limit and they adjusted their demands accordingly.

The third and final experiment examined the interplay between experienced and communicated emotion. It showed that angry communications (unlike happy ones) induced fear and thereby mitigated the effect of the counterpart’s experienced emotion.

Conclusion

In conclusion, the study by Van Kleef and colleagues found that negotiators are influenced by their counterpart’s emotions. It showed that the expression of anger can be advantageous in some negotiation scenarios, challenging the “golden rule” that always being nice wins.

However, being angry or nasty doesn’t mean acting unethically. And if a person is simply acting a certain way, doing so could backfire if their counterpart sees through the display.

Based on the study and additional resources delineated in the references/sources section of this article, here are some considerations regarding behavior and mood during negotiations.

When to be nice in negotiations:

  • Long-term relationships: In repeated negotiations, fostering goodwill with friendly gestures like concessions or expressing empathy can benefit both parties in the long run. It builds trust and cooperation, creating a more positive environment for future deals.
  • Information exchange: When seeking information from your counterpart, a friendly approach encourages them to be open and share more readily. Creating a comfortable atmosphere lowers their guard and increases cooperation.
  • Concessions for compromise: When seeking a compromise, initiating friendliness can signal your willingness to concede and encourage reciprocation from the other party, leading to a mutually beneficial agreement.

When to be nasty in negotiations:

  • Short-term gains: In one-off negotiations, a strategic display of toughness (e.g., setting high demands, expressing firm resolve) can intimidate your opponent and pressure them into accepting less favorable terms.
  • Protecting resources: When facing an unfair or demanding adversary, a firm and assertive stance can help protect your resources and prevent exploitation.
  • Signaling strength: In situations where your bargaining power is unclear, projecting confidence and strength through assertive communication can deter the other party from taking advantage of you.

"This document summarizes the accomplishments of a three-year project funded by the U.S. Department of Energy (DOE) under its Grid Modernization Initiative, which is working across DOE to create the modern grid of the future. The project, titled 'Grid Modernization Laboratory Consortium (GMLC) 1.1: Metrics Analysis' (hereafter GMLC Metrics project) was undertaken by the Grid Modernization Laboratory Consortium (GMLC) Metrics team (hereafter GMLC Metrics team), which consists of national laboratory sub-teams each dedicated to developing one of six volumes in the set of reference documents about new grid metrics."

"This first volume describes the importance of metrics for grid modernization and then introduces the six categories of metrics DOE has developed to guide the Grid Modernization Initiative—(1) reliability, (2) resilience, (3) flexibility, (4) sustainability, (5) affordability, and (6) security. It then describes the approach the Grid Metrics team took to working directly with industry stakeholders to develop new grid metrics and demonstrate their use. This report is accompanied by six separate reference documents that provide more detail about the work of the GMLC Metrics sub-teams on each of the six metrics categories and assess the current uses of metrics in these each of the categories to inform grid modernization."
